HIPAA treats every college-age kid like an adult. (Whether or not they act like one.)

Posted on: August 22nd, 2011
The vast majority of incoming college freshmen are at least 18-years-old. While you may still be doing their laundry for years, there’s no escaping the fact that, legally, they are adults.

That's why it's a good idea to have them sign health care directives authorizing you, their parents and adult guardians, access to their health information, as well as the power of to make medical decisions in an emergency.

Sure, you may have seen them through every bump, bruise, brake, scrape and stitch since they were born. But if they get sick or have an accident while away at college, medical providers may be prohibited from sharing your adult child’s "private health information," even with you.

However, making the information readily available is key. If a health care provider cannot easily access health care directives in an emergency, it could compromise their effectiveness, despite the most careful preparation.

At Constant Law Group, we take steps to ensure that all appropriate parties can access these instructions when they are most needed, 24/7.

Here’s how it works.

First, we store signed health care directives digitally on a secure online site. Then, we provide an emergency card for your child to carry in his or her wallet or purse.

This card provides access to emergency contact information, as well as to your child’s insurance information, medical conditions (such as an allergy) and medical directives. If a situation arises where this information is needed, both hospital and family members can use this convenient reference to gain immediate access to this valuable medical information – anytime, anywhere.

The result? An emergency medical access program that provides peace of mind about your child’s well being. Well, as much as possible for a young adult who’s likely to subsist on too many Ramen Noodles and pizza.
